A former NYC police office has a real bone to pick with Bumble Bee Foods over an unwanted secret ingredient he claims turned up in his tuna sandwich.
More than two years after Robert McKenna says he nearly choked on a bone in his tuna, the retired NYPD lieutenant says the incident still sticks in his craw.
So McKenna is filing a $100,000 lawsuit against Bumble Bee and Costco, where his wife bought the six-ounce cans of solid white albacore she used to make the sandwich.
"It was a great sandwich. I love tuna," McKenna said. "Just not anymore."
The 57-year-old private investigator was taking a break from renovating his kitchen on May 23, 2007, when he said he felt something odd upon biting into a kaiser roll with tuna, lettuce and tomato.
"I was choking on that bone for more than a minute," McKenna said. "It felt like forever."
The suit, filed in Staten Island Supreme Court, says McKenna was "nearly blacking out" before dislodging a "sharp, hard bone approximately one and one half inches in length."
McKenna insisted he is not peddling a fish tale and said he is suing only after fruitlessly going back and forth over a settlement with Bumble Bee. The company, he said, conducted a lab test confirming what went into his mouth was a tuna bone.
"It's a pretty large bone," McKenna said. "It's crazy."
A spokeswoman for Bumble Bee did not respond to a request for comment.
The suit says McKenna, who can no longer stand the smell or taste of tuna, suffered "permanent and emotional pain and suffering" and was "in imminent fear of losing his life."
"I can't even be near tuna now," he said. "Like a fish fillet sandwich? Forget it."
